UNITED NATIONS (AP) ? Secretary-General Ban Ki-moon on Thursday raised the death toll in Syria's civil war to more than 100,000, up from nearly 93,000 just over a month ago.
Ban called on the Syrian government and opposition to halt the violence in the 2 ? year civil war, saying it is "imperative to have a peace conference in Geneva as soon as possible."
The secretary-general spoke before talks with U.S. Secretary of State John Kerry, who stood nearby.
"There is no military solution to Syria," Kerry then told reporters. "There is only a political solution, and that will require leadership in order to bring people to the table."
The United States and Russia are trying to convene an international conference in Geneva, along with the United Nations, to try to agree on a transitional government based on a plan adopted in that city a year ago.
Kerry said he talked to Russian Foreign Minister Sergey Lavrov on Wednesday and that both countries remained committed to bringing the warring parties together to further peace efforts.
"We will try our hardest to make that happen as soon as is possible," Kerry said.

US court ruling in NY favors anti-terror law
NEW YORK (AP) ? A federal appeals court in Manhattan has revived enforcement of a law that permits the indefinite detention of people suspected of supporting terrorists, saying a lower court mistakenly ruled for plaintiffs who opposed it.
The 2nd U.S. Circuit Court of Appeals issued the ruling Wednesday in a lawsuit challenging the law that allows the U.S. government to detain anyone who "substantially" or "directly" provides "support" to radical forces, such as al-Qaida or the Taliban. The court found that the plaintiffs had no standing to bring the case in the first place.
In response to the decision, a lawyer for the plaintiffs, Bruce Afran, accused the appeals court of failing to address the merits of the case by instead reversing the lower court's decision on technical grounds. A spokeswoman for the U.S. Attorney's Office in Manhattan had no comment.
The decision sent the case back to the district court to let the judge consider further proceedings. But Afran said it was unclear whether that would happen.
In a ruling last year, U.S. District Judge Katherine Forrest found that the law was "unconstitutionally overbroad." She urged Congress to make it more specific so journalists, scholars, political activists and others would not worry that contacting enemies of the United States would put them in jeopardy of indefinite incarceration.
"First Amendment rights are guaranteed by the Constitution and cannot be legislated away," Forrest wrote. "This court rejects the government's suggestion that American citizens can be placed in military detention indefinitely, for acts they could not predict might subject them to detention."
The appeals court found that the plaintiffs who are U.S. citizens, including Pulitzer Prize-winning journalist Christopher Hedges, "do not have standing to challenge the statute" because the relevant section "simply says nothing about the government's authority to detain citizens."
Other plaintiffs, including foreign political activists, also failed to show they had ground to fear the law, even though it "does have meaningful effect regarding the authority to detain individuals who are not citizens or lawful resident aliens," the appeals panel said.
Hedges has interviewed al-Qaida members, mixed with members of the Taliban during speaking engagements overseas and reported on 17 groups named on a list prepared by the State Department of known terrorist organizations. He testified that the law has forced him to consider altering speeches where members of al-Qaida or the Taliban might be present.
Government lawyers had argued that the fears of journalists and others were unfounded. They claimed that the 2011 statute simply reaffirms powers authorized by Congress after the Sept. 11, 2001, terror attacks.
But Afran said the appeals court decision "follows a disturbing and dangerous trend in which the federal courts are refusing to address the merits of civil liberties cases. It sends a message that you can't go to court unless the military is knocking at your door ready to take you into custody."

Apple reportedly hiring new talent to solve iWatch design problems
Rumors, suggestions and trademark applications have been building a case for an wrist-worn Apple product for some time now -- an official iWatch to fulfill the wearable potential of the iPod Nano. Now, the Financial Times says the company is "aggressively" hiring to help it get the product ready for release. According to the usual sources familiar with the matter, the new staff might have been sought out to help Apple wrap its head around wearable computing, moving the project to the next stage of development. The timing of the hires might also imply that the iWatch won't be ready until late next year. Of course, if you can't wait that long, you can always just make your own.

Appeal expected in ex-Bengals cheerleader lawsuit
COVINGTON, Ky. (AP) ? A gossip website operator who lost a defamation lawsuit brought by a former Cincinnati Bengals cheerleader plans to appeal, and some First Amendment lawyers warn the verdict could adversely affect other websites.
A federal court jury in Covington, Ky., awarded Sarah Jones $338,000 in damages Thursday, finding that posts about Jones on the Scottsdale, Ariz.-based website thedirty.com in 2009 were substantially false.
The jury also found website operator Nik Richie acted with malice or reckless disregard in posting the submissions he said were anonymous.
One post alleged Jones had sex with every Bengals player, and the other said she probably had two sexually transmitted diseases. Jones said the posts were false and caused her severe mental anguish.
Richie denied any malice and said he wasn't required to fact-check anonymous submissions before posting them.
The posts were unrelated to Jones' 2012 guilty plea to charges she had sex with an underage former student. Jones avoided jail time, but was forbidden from teaching again. She and the now 18-year-old former student have said they plan to marry.
Cincinnati attorney Jack Greiner, who specializes in media and free speech issues, said the lawsuit verdict could have a chilling effect on other website operators.
"I think it could put some limits on the ability of a website operator to feel free to post comments that might be offensive or controversial or even just critical," Greiner said. "People might err on the side of caution and not take a risk, even if comments are acceptable."
Richie's attorney, David Gingras, also believes holding Richie responsible for posts created by a third party will have a negative effect on free speech for other people and websites.
Gingras previously asked U.S. District Judge William Bertelsman to dismiss the lawsuit, saying Richie's website and others around the country are protected under the Communications Decency Act. Part of that law was intended to provide immunity to website operators from liability for content that comes from third parties.
The judge ruled that law did not shield thedirty.com from liability.
"There's no question that his ruling is wrong," said Gingras, who has won similar lawsuits on the same issue.
But Jones' attorney, Eric Deters, said Richie has acknowledged screening submissions, deciding which comments are posted and adding his own comments. That makes the thedirty.com different from other websites like Facebook where people post their own comments.
"Judge Bertelsman got it right," Deters said, adding he is confident of winning any appeal.
He hopes the verdict will "reduce the number of defamation comments made on these types of websites."
But Nate Cardozo, of the Electronic Frontier Foundation that focuses on civil liberties and privacy issues in the digital age, told The Associated Press "the judge got it dead wrong."
Jones could sue for false statements but "she can only sue the person who made the statements," said Cardozo, a staff attorney with the nonprofit foundation.
A message left for the judge was not immediately returned.
Jones, 28, said Thursday that she was grateful to the jury for hearing the evidence and basing its decision on that evidence.
A January trial of the lawsuit produced a hung jury. Jurors in the retrial deliberated over two days.

20th Century Fox to create musicals from its films
NEW YORK (AP) ? Get ready for more stage versions of your favorite movies ? 20th Century Fox has formed a new joint venture to turn the studio's vast arsenal of films into musicals.
The studio said Thursday it has joined up with Tony Award-winner producer Kevin McCollum, film producer John Davis and entertainment executive Tom McGrath to develop at least nine musicals based upon the studio's films over the next several years.
The three will continue to work on other projects while collaborating with Fox.
The move takes 20th Century Fox from a licenser of films into a player on Broadway, adding its heft to already established film studios operating in Times Square, including Disney, Warner Bros., Sony and MGM.
But 20th Century Fox ? which includes the units Twentieth Century Fox, Fox 2000 Pictures, Fox Searchlight Pictures, Fox International Productions and Twentieth Century Fox Animation ? has a mouth-watering list of films that range from "Cocoon" and "Carmen Jones" to "Zorba the Greek" and "There's Something About Mary."
McCollum put together the Broadway hits "Rent," ''Avenue Q" and "In the Heights." Davis was behind the movies "Predator," ''The Firm," ''Grumpy Old Men" and "I Robot." McGrath, a former executive with Viacom Entertainment Group, currently helps lead Crossroads Media, Inc.
They will be aided by Isaac Robert Hurwitz, the executive director and producer of The New York Musical Theatre Festival, who will act as a consultant.

Google Maps App Bringing Back Offline Maps Button ASAP
Yesterday we reported that part of the Google Maps App "upgrade" a few features went away. One such feature was easy access to offline maps.
Google removed the offline maps button and said to take your maps offline, you need to search for "OK Maps" and it will save the map you are on for offline viewing.
As you can imagine, users did not like that. Google listened and is rushing out an update to bring a button to the Android version that reads "Make this map area available offline."

University archaeologists unearth well-kept secrets

The well, which is thought to have been in use for several decades in the late 4th and early 5th centuries, was unearthed during archaeological excavations on the site of the University?s campus expansion at Heslington East.
From at least the Early Bronze Age, a range of methods were used here to access natural springs, including watering holes and primitive wells. In contrast, this Late Roman feature was carefully engineered, positioned high on a hillside and used newly acquired, good-quality masonry.
The research published in the latest issue of Internet Archaeology says that the well's main structure featured facing stones of newly quarried, roughly squared, oolitic limestone blocks, probably from a? source near Malton, 30km to the north-east. Curved on their outer surface, the stones were set in carefully defined, regular courses. The base of the well was dish-shaped and composed of triangular limestone slabs set directly on natural clay. The engineering employed suggests an intimate understanding of the subsoil. The masonry lining did however incorporate a former roof finial, the only element from any earlier structure to be reused. The excavation team from the Department of Archaeology at York say its recycling is best interpreted as symbolic rather than opportunistic.
The well contained more than a 1000 pieces of Romano-British pottery, including two almost complete Huntcliff-type jars, and a similar number of animal bone fragments. These featured sheep, cattle, horse, deer and even a young dog. A high proportion of the bones showed signs of being butchered but were not highly fragmented, in contrast to the domestic waste encountered on the rest of the site.
Steve Roskams, Senior Lecturer, said: ?It is striking that all of the material found in our well would have been familiar to those inhabiting this landscape. Its construction incorporates a finial which, we argue, probably came from the dismantling of a nearby, good-quality structure. The jars circulated here widely, the Huntcliff-type probably being connected directly to water usage.? The other pottery and the animal bones also comprise well-understood 'mundane' elements that were available locally.
?At the same time, there is sufficient evidence to indicate that some of this fairly ordinary material was deliberately placed in the well as symbolic performance. When interpreting such practices, archaeologists often concern themselves with whether they belong to ?Roman? or ?Iron Age? traditions. However, if we are to understand these forms of routine ritual fully, we would do better to look to local agricultural cycles and fertility practices, whether annual, generational or longer-term transitions. The economic pressures and social tensions, which came to fore at such points, were of far greater significance to these communities as they sought to establish and reinforce their own, immediate identities.?

According to a recent report by KPMG Nearly all C-level executives understand that risk management is an important ingredient in their businesses overall success. The report highlighted that 86% of the surveyed participants said that risk management considerations are to some degree factored into strategic planning decisions.
However, companies will have difficulty developing a strategic plan without knowing their appetite for risk, and whether they are taking on too much risk for a given level of return or too little.
Organisations may find they can afford to increase their risk appetite, assuming the business gains are high enough. But they won?t know if they don?t develop a framework of their appetite for risk. Indeed, a key question for executives is:
How to reach a common understanding of the company?s risk appetite, as part of the strategic planning process?
According to the survey results,
- Less than 19% of companies have developed a formal risk appetite statement.
- A further 22% say an appetite statement is being developed.
- Circa 40% say that a statement has been created, but not communicated across the organisation.
- And 19 % say it has not been developed at all.
These statistics show that there has been some progress in creating risk appetite statements, but businesses need to try harder to develop these statements for decision making.

Death toll at 50 as 30 missing now presumed dead in Quebec train crash; engineer suspended
Though terrorism has been ruled out in the train crash that killed at least 15 in Quebec on Saturday morning, officials are examining whether criminal tampering is to blame. NBC's Tom Costello reports.

The body count after an oil train derailed in a Quebec town rose to 20 people Wednesday with 30 others missing now presumed dead, and the railway's chief said a train engineer is "under police control" for the tragedy.
Ed Burkhardt, chairman of Montreal Maine & Atlantic Railway, was met by jeers from residents and cries of "murderer" as he spoke at an impromptu news conference in Lac-Megantic on Wednesday in which he said the engineer had been suspended without pay, CBC TV reported.
?It was our employee that was responsible for setting the brakes on the train ? That employee is under investigation and is not working,? Burkhardt said, CBC reported.
Burkhardt said the engineer was originally believed when he said all 11 hand brakes had been applied on the train, but now there are doubts about the worker's story.
?We think that he applied some handbrakes, the problem is that he didn?t apply enough of them,? Burkhardt said, according to CBC.
The engineer parked the train late Friday night, investigators from the Transportation Safety Board of Canada have said, then went to sleep at a nearby hotel.
A fire was reported on the train later that night by another employee, according to the TSB. After firefighters left the scene the train started to roll downhill, derailed and exploded in a huge fireball Saturday in the town of 6,000 near the Maine border.
The move to suspend the engineer came on a day police reported the confirmed death toll in the tragedy had risen to 20 people after five more bodies were recovered, with another 30 still considered missing but likely dead.
"Now we are standing here with a number of 50 persons that we are considering now as missing and most probably dead in this tragedy," police?spokesman Michel Forget told reporters.
Police are investigating whether the disaster involved foul play or criminal negligence, but Forget deflected questions about potential criminal charges. Forget said any charges were up to Quebec prosecutors.
There have been no arrests to date, he said.
Lac-Megantic is about 160 miles east of Montreal and close to the border with Maine and Vermont.
The engineer, named by Canadian media as Tom Harding, lives on a quiet street in Farnham, Quebec, some 90 minutes west of Lac-Magentic, in a two-story stone and vinyl-siding home, Reuters reported. Nobody answered the door at the house on Wednesday.?

Researchers crabgrass hydroponically, so they could easily capture any chemicals released by the plant's roots. Then they dripped that hydroponic solution into pots of wheat, corn and soybean seedlings. Two weeks later, they dried and weighed the seedlings. And sure enough, the crabgrass solution had significantly stunted the seedlings? growth, compared to control plants. And since corn is in the same family as lawn grasses, the crabgrass toxic effect may also spell bad news for your beautiful Kentucky bluegrass.
The researchers still aren't exactly sure how crabgrass' chemical weapons work. But the weed can wipe out beneficial bacteria and fungi in the soil, too. So it?s possible that crabgrass poisons its neighbors directly, by releasing toxins, and indirectly, by creating inhospitable soil. Either way, it's bound to make lawn owners crabby.

CAIRO (AP) ? Egypt's interim president named an economist as prime minister Tuesday, ending days of deadlock as the head of the military pressured political factions to speed along the process, warning them that "maneuvering" must not hold up the transition toward new elections after the ouster of President Mohammed Morsi.
The appointment of Hazem el-Bebawi, along with the setting of a swift timetable for parliamentary and presidential elections early next year, underlined the military-backed leadership's determination to push ahead with their transition plans in the face of Islamist protests demanding the reinstatement of Morsi, Egypt's first freely elected president.
The new leadership got a boost Tuesday from Arab allies in the Gulf. Saudi Arabia and the United Arab Emirates, both opponents of Morsi's Muslim Brotherhood, celebrated his ouster by showering the cash-strapped Egyptian government with promises of $8 billion worth of cash grants, loans and badly needed gas and oil.
In doing so, they are effectively stepping in for Morsi's Gulf patron, Qatar, a close ally of the Brotherhood that gave his government several billion in aid. During Morsi's year in office, he and his officials toured multiple countries seeking cash to prop up rapidly draining foreign currency reserves and plug mounting deficits ? at times getting a cold shoulder.
The developments underlined the multiple pressures on the new leadership even with the country still in turmoil after what Morsi's supporters have called a coup against democracy.
The military faces calls, from the United States and Western allies in particular, to show that civilians are in charge and Egypt is on a path toward a new democratically based leadership. The nascent government will soon face demands it tackle economic woes that mounted during Morsi's year in office, including fuel shortages, electricity cut-offs and inflation.
And there are signs of discontent over the transition plan among those participating in the military-backed political process.
The secular, revolutionary youth movement Tamarod, which organized last week's massive protests against Morsi, criticized the transition plan Tuesday, in part because it gives too much power to the interim president, Adly Mansour. An Islamist party was unhappy that appointed panels ? not elected ones ? will amend the constitution.
At the same time, the country is deeply polarized, raising the threat of violence, particularly after more than 50 Morsi supporters were killed by security forces in clashes early Monday. The Brotherhood and Islamist allies say they are under siege by a crackdown from the military that has jailed five of their top leaders and shut down their media outlets.
The Brotherhood on Tuesday rejected the transition plan, as tens of thousands of its supporters massed for another day in a rally outside a Cairo mosque where they have vowed to stay until Morsi is restored. The crowds waved signs of the ousted leader and brought in coffins draped with Egyptian flags representing the slain protesters.
"This new declaration affirms that those who carried out the coup, the dictator generals, don't respect the will of the people," the Brotherhood said of the transition timetable in a statement. "These are all rejected and void measures."
Still, there was not the huge nationwide turnout Brotherhood leaders had called for in the wake of the killings. Also, for the first time since even before the June 30 protests began, Cairo's Tahrir Square ? where Morsi's opponents were centered ? was largely without crowds.
That could in part reflect the fact that people are starting to prepare for the start of the Islamic holy month of Ramadan on Wednesday, when Muslims will begin 30 days of fasting from sunrise to sunset. But it is not clear if the month will significantly calm the street. The fast cuts down on activity during the day, but the street rallies have been largely nocturnal affairs anyway. The Islamist camp will likely use the religious occasion to rally its base.
The interim president called for a reconciliation process called "One People" to begin in Ramadan, traditionally a period for Muslims to promote unity. It called for parties and movements to hold meetings. There was no sign the Brotherhood and its allies would attend, much like Morsi's opponents rejected his calls for dialogue, which were dismissed as empty gestures.
In an effort at outreach, the interim president's spokesman Ahmed el-Musalamani said that posts in the new Cabinet would be offered to the Islamist camp ? including to the Brotherhood's Freedom and Justice Party and the Salafi Al-Nour Party. He spoke to Egypt's privately owned CBC TV channel in remarks also carried by the state news agency.
The statement by military chief Gen. Abdel-Fattah el-Sissi against political maneuvering underlined how the military ? while it says it is staying out of politics ? remains a powerful presence in a transition ostensibly being led by Mansour and a loose coalition of political groupings that backed the army's removal of Morsi.
"The people and, behind it, the armed forces don't want anyone to stray from the right path or deviate from the boundaries of safety and security, driven by selfishness or ... zealousness," the military said.
A spokesman of the interim president announced the appointment of el-Bebawi as prime minister and of pro-democracy leader Mohamed ElBaradei as vice president. El-Bebawi is to start forming a Cabinet on Wednesday.
The naming of a prime minister had been held up for days as the sole Islamist faction among them, the ultraconservative Al-Nour Party, blocked candidates from secular, liberal and leftist factions. Those factions have been determined to have one of their own in the post.
Last week, Al-Nour blocked ElBaradei from becoming prime minister then objected to one his close allies put forward as a compromise. It insisted it wanted a less political figure. The moves infuriated the secular and liberal factions. ElBaradei is considered one of the strongest pro-reform figures, but many Islamists vehemently oppose him, considering him too secular.
El-Bebawi is from the liberal-secular camp ? albeit a less controversial, well-known or prominent figure than ElBaradei, who will now get a vice president post. Some of ElBaradei's supporters believe he will work to shape the government and political process from that position.
Gen. el-Sissi's statement, read on state TV, appeared to be a veiled warning to Al-Nour. But it suggests the military is ready to apply pressure on the politicians in the future, when multiple disputes are almost certain to emerge.
"The future of the nation is too important and sacred for maneuvers or hindrance, whatever the justifications," el-Sissi said.
An Al-Nour spokesman, Ibrahim Abaza, told AP that the party was not consulted on el-Beblawi's nomination but welcomes his appointment. But he underlined that "our objections are not only about nominations but the dictatorship of the new president, who takes decisions unilaterally without consultations and with clear bias against Islamist current."
El-Beblawi, 76, served as finance minister in one of the first cabinets formed after autocrat Hosni Mubarak was ousted in 2011 and the military stepped in to rule for nearly 17 months. But he resigned in protest in October 2011 after 26 protesters, mostly Christians, were killed by troops and security forces in a crackdown on their march.
A Sorbonnne-educated economist has been a professor in several Egyptian universities and served in the United Nations for six years in the U.N. Social Economic Commission for Western Asia. After Mubarak's fall, he was one of the founders of the Egyptian Social Democratic party, one of several secular parties in the liberal grouping National Salvation Front in which ElBaradei is a leading figure.
He called for dialogue between the new leadership and their Islamist opponents in the streets. "Everyone in Egypt must sit together on the table for dialogue to solve current political differences, stop violence and bloodshed in the street," he told The Associated Press.
Late Monday, Mansour issued a declaration that included a temporary, truncated constitution and the timetable for the transition period.
But it quickly brought out the strains among the factions that have a seat at the table in discussions over the transition.
The anti-Morsi protest movement Tamarod, Arabic for "rebel," said it was not consulted on the declaration. It said the declaration gave too much power to Mansour, including the power to legislate, since there is no parliament. A post-Morsi plan put forward by Tamarod called for a largely ceremonial interim president with most power in the hands of the prime minister.
It also complained that the process will involve amending the Islamist-drafted constitution passed under Morsi's administration instead of completely throwing it out and writing a new one.
"The people didn't have a revolution to bring back the Muslim Brotherhood constitution. We don't want a patchwork constitution. We want a new one," said one of Tamarod's founders, Walid el-Masry, who added that the group would meet with Mansour to press for changes to the declaration.
Under the timetable issued Monday, two appointed panels would draw up and approve amendments to the constitution, which would be put to a referendum within 4 ? months from now. Elections for a new parliament would be held within two months of that. Once the new parliament convenes, it would have a week to set a date for presidential elections.
After Monday's bloodshed, authorities stepped up moves against Islamists.
The military accused armed Islamists of sparking Monday's carnage by attacking the headquarters of the Republican Guard. Morsi supporters say no such attack took place and that troops attacked their sit-in nearby, opening fire on them without provocation after dawn prayers. Along with 51 protesters, an army officer and two policemen were killed.
An Egyptian security official said 650 people were arrested, most during Monday's violence, for allegedly trying to storm the headquarters. The official said there were Syrian and Palestinian nationals among those arrested. The official spoke on condition of anonymity because he was not authorized to talk to the press.
The general prosecutor announced that authorities confiscated weapons, knives and home-made explosives and bombs from the sit-in site and that investigations found that armed men have used rooftops of residential and government building to fire at the Republican Guard forces.
Egypt also chided the Islamist-rooted governments of Turkey and Tunisia that criticized the army's ouster of the president. The Foreign Ministry summoned the Turkish ambassador to complain of interference in internal affairs after Turkish officials called for U.N. intervention.

'Like a war zone': 40 missing after runaway freight train explosion in Quebec
More than 40 people are still unaccounted for after an oil train derailed and exploded over the weekend in eastern Quebec. Five people are confirmed dead.

The bodies of up to 40 people missing after a runaway train carrying crude oil slammed into a Quebec town may never be recovered, officials warned late Sunday.
Five others were already confirmed dead in the disaster which triggered an intense blaze. Canadian Prime Minister Stephen Harper said the small town of Lac-Megantic looked ?like a war zone.?
The train, hauling 72 tanker cars from North Dakota to eastern Canada, rolled seven miles downhill from an overnight parking spot and derailed on a curve at 1 a.m. ET on Saturday.
The subsequent explosion and fireball sent flames hundreds of feet into the air and flattened dozens of buildings, including a popular bar. Each car carried 30,000 gallons of crude oil.
About 40 people were missing, police spokesman Michel Brunet told reporters late Sunday.
Very few people were treated in hospitals after the accident, indicating that those missing had either escaped or died. "It is a black-and-white situation," said Quebec Health Minister Rejean Hebert, according to Reuters.
The fire's intensity means it is possible that the bodies of some of the victims may never be recovered, Genevi?ve Guilbault, a spokeswoman for the Quebec coroner?s office, told ?the Montreal Gazette.
?Right now, we?re working on those we are able to recover,? Guilbault said, according to the newspaper. The five bodies recovered so far will be sent to Montreal for forensic identification.
?We can deduce that many of the bodies are severely burned,? Guilbault said. ?That complicates identification, but all necessary means at our disposal will be used to identify them.?
Harper toured the scene on Sunday, calling it an ?unbelievable disaster.?
"It looks like a war zone here," he said. "There isn't a family in this area that is not touched by this, that is not affected by this."
Investigators are focusing on how the train?s brakes came to be released.

"Certainly, the manner in which the train was secured, both hand brakes and air brakes - we'll be looking very strongly at that," Donald Ross of Canada?s Transportation Safety Board told a news conference.
The train?s data recorder has been recovered from the crash site, he added.
Montreal, Maine and Atlantic Railway, the company that owns the train, said in a statement Sunday that a locomotive, left running overnight in order to hold the train in place, had been shut down.
?One fact that has emerged is the locomotive of the oil train parked at Nantes station was shut down subsequent to the departure of the engineer who had handled the train from Farnham, which may have resulted in the release of air brakes on the locomotive that was holding the train in place,? the company said.
Ed Burkhardt, chairman and chief executive of privately owned Rail World, MM&A's parent, told the Wall Street Journal that the engineer had left the hand brakes on all the locomotives and the air brake, a high-pressure stop, on the lead engine.
"He complied with all of the rules," Burkhardt told the newspaper.
Burkhardt said that "several hours" after the engineer left, someone shut down the train?he said he didn't know who it was. "There are some things I would like to know, like who turned off this locomotive," he said.
Sylvain Gilbert, mayor of the town of Nantes ? where the train had been parked ? told local radio that town firefighters had already dealt with a fire on the train earlier on Friday night, Reuters reported.
It was not clear if that fire was connected in any way to the derailment, or why the train became unsecured in Nantes.
Residents said they were particularly concerned about people who had been inside the Musi-Cafe bar, a popular night spot located next to the center of the blast, Reuters reported.
"There was a big explosion, the heat reached the cafe and then a big wall of fire enveloped the road," said Bernard Theberge, who was sitting on the patio of the restaurant as the train barreled into town. "There were people inside. I thought for maybe two seconds that I should go in, but the heat was too strong to get to the door."
At 7 p.m. on Sunday, more than 40 hours after the accident, firefighters said the blaze was out.
Lac-Megantic, a lakeside town of 6,000 ringed by forests of pine and birch, is in the predominantly French-speaking province of Quebec, about 160 miles east of Montreal and close to the border with Maine and Vermont. About 2,000 people, a third of the population, were evacuated.
